What pharma company registration actually involves

Registering a pharma company is really two steps that people often confuse for one. First, you incorporate the legal entity — almost always a Private Limited company — through the MCA's SPICe+ system, exactly like any other business. Second, and separately, you obtain the drug licence and any manufacturing approvals you need under the Drugs and Cosmetics Act, 1940.

Important:

Company registration does not give you the right to make or sell medicines. That comes from the drug licence, issued by the State Drugs Control Administration (or CDSCO for manufacturing). We incorporate the company first, then guide you into the correct licence for your model.

Which type of pharma company are you building?

MARKETING / PCD

Pharma marketing & PCD franchise

You brand and sell, but outsource manufacturing on a third-party or loan-licence basis. Needs a wholesale drug licence — no factory required. The most common first company.

WHOLESALE

Distribution & wholesale

Stocking and supplying medicines to retailers or hospitals. Requires a wholesale drug licence and a competent person with the prescribed experience.

MANUFACTURING

Manufacturing unit

Making formulations yourself. Requires a manufacturing licence, GMP-compliant premises, and technical staff — the most regulated route.

RETAIL

Retail pharmacy

A chemist / pharmacy outlet. Requires a retail drug licence and a registered pharmacist on premises.

Licences & approvals beyond incorporation

Drug Licence

Retail or wholesale, from the State Drugs Control Administration under the Drugs and Cosmetics Act. Needs a qualified pharmacist (retail) or competent person (wholesale) and approved premises.

Manufacturing & GMP

For your own production — a manufacturing licence plus GMP-compliant facility and technical staff, cleared by the State/CDSCO. Inspection-based.

GST & NIC code

GST registration is needed to trade. Pick the right NIC code — [confirm: NIC Div 21 manufacturing / wholesale-pharma code] — at incorporation, so it matches your licence.

Pharma registration FAQs

What is the pharma company registration process in India?
Incorporate a Private Limited company through SPICe+, then obtain your drug licence and any manufacturing approvals separately under the Drugs and Cosmetics Act. Incorporation is about 7 working days; licences follow.
Do I need a drug licence to register a pharma company?
They're two separate steps. You can incorporate the company first; the retail, wholesale or manufacturing drug licence is obtained afterward from the State Drugs Control Administration or CDSCO.
Can I register a pharma marketing (PCD) company without a factory?
Yes. A marketing or PCD-franchise company outsources manufacturing on a third-party or loan-licence basis, but still needs a wholesale drug licence to trade in medicines.
Which NIC code is used for a pharma company?
Manufacturing typically uses NIC Division 21 (pharmaceutical manufacturing); wholesale/trading uses the wholesale-of-pharmaceutical-goods code. The right code depends on your activity — we set it at incorporation to match your licence.
How much does pharma company registration cost?
The company registration itself is ₹8,999 all-inclusive for a 2-director Private Limited Company. Drug licences and manufacturing approvals are separate government processes, quoted case by case.
How long does it take to register a pharma company?
The Private Limited incorporation is typically 7 working days. Drug licences take additional time depending on the state authority and inspection.
