How to file your ITR without Form 16

Form 16 is just a TDS certificate from your employer — a convenience, not a requirement to file. If you changed jobs, your employer didn’t issue one, or you have no employer at all, you can still file accurately using your payslips, Form 26AS and AIS. Here’s how.

The quick answer

Yes — you can file your ITR without Form 16. Rebuild your salary from payslips, confirm the tax deducted from Form 26AS, and cross-check every other income in your AIS. Match those three and your return is as solid as one filed with Form 16.

Why you might not have one

No Form 16 is more common than you think

An employer must issue Form 16 only if they deducted TDS from your salary. Plenty of people never get one — and still have to file.

No TDS was deducted

If your salary was below the TDS threshold, your employer wasn’t required to deduct tax — so no Form 16 is issued.

You changed jobs

One of your employers didn’t issue Form 16, or your exit formalities were incomplete.

The employer shut down

Or delayed issuance — the company is gone or unresponsive, but you still need to file.

You have no employer

Freelancers, consultants and business owners never receive a Form 16 in the first place.

Your replacement toolkit

Five documents that stand in for Form 16

Form 16 only bundles information that already exists elsewhere. Gather these and you have everything Form 16 would have told you — and more.

  • Salary slips (all employers)Your gross salary, allowances like HRA, and any bonus or arrears for the year.
  • Form 26ASThe government’s record of TDS deposited against your PAN — your proof of tax already paid.
  • AIS (Annual Information Statement)The full picture: salary, interest, dividends, mutual-fund and property transactions reported to the department.
  • Bank statementsTo pick up savings and FD interest, and any income not captured above.
  • Investment & rent proofsReceipts for 80C, 80D, and rent receipts for HRA — so you claim every deduction yourself.

The process

Five steps to file without Form 16

1

Total your gross salary

Add up salary from every payslip for the year — across all employers — plus bonus and arrears.

2

Confirm TDS & income in 26AS and AIS

Form 26AS shows tax deposited against your PAN; AIS adds interest, dividends and other income the department already knows.

3

Add all other income

Savings and FD interest, capital gains, rent — everything in your AIS and bank statements goes in.

4

Claim your deductions yourself

80C, 80D and HRA (with rent receipts) — claim them directly from your proofs; you don’t need a Form 16 to do it.

5

Pick a regime, file & e-verify

Choose old or new, compute the tax, file the right ITR form, and e-verify within 30 days — or it counts as not filed.

The notice trap

Reconcile — or risk a scrutiny notice

Filing without Form 16 is fine. Filing without checking against 26AS and AIS is where notices come from — the department already knows your numbers.

Mismatch with 26AS / AIS

If your declared income or TDS doesn’t match these records, the return gets flagged. Reconcile before you file — spot a wrong entry, get it corrected first.

Missed “other” income

Savings-account interest, dividends and mutual-fund redemptions are the most overlooked — and they all sit in your AIS, visible to the department.

Unproven deductions

Claim only what you can back with a receipt. Without a Form 16 to anchor them, your own proofs are what stand up to a query.

Skip the reconstruction headache

Let a CA rebuild and file it for you

Reconstructing salary and reconciling 26AS with AIS is exactly where do-it-yourself returns go wrong. We pull your records, match every figure, claim the deductions you’re owed, and file clean — no Form 16 needed.

FAQ

Filing without Form 16, answered

Can I file my ITR without Form 16?
Yes. Form 16 is a TDS certificate from your employer — a convenience, not a legal requirement to file. You can file accurately using your salary slips, Form 26AS, AIS, bank statements and investment proofs.
Why didn’t I get a Form 16?
An employer must issue Form 16 only if they deducted TDS from your salary. If no tax was deducted, you changed jobs, your exit was incomplete, or the company shut down, you may not receive one. Freelancers and business owners never get a Form 16.
How do I know how much TDS was deducted without Form 16?
Check Form 26AS — it is the government’s record of all tax deposited against your PAN. Download it free from the income tax portal and cross-check it with your AIS.
What documents do I need instead of Form 16?
Salary slips from all employers, Form 26AS, your AIS, bank statements, and proofs for any deductions (80C, 80D) and rent receipts for HRA.
What is the biggest risk of filing without Form 16?
A mismatch with Form 26AS or AIS. The department already knows your reported income — if your return doesn’t reconcile, it can be flagged for scrutiny. The most overlooked items are savings interest, dividends and mutual-fund redemptions.
Which ITR form should I use?
It depends on your income, not on Form 16. Salaried individuals use ITR-1 or ITR-2; freelancers and business owners use ITR-3 or ITR-4. Using the wrong form makes the return defective.
Can I claim HRA and 80C without Form 16?
Yes. You can claim every deduction you are entitled to directly in your ITR, backed by your own proofs — rent receipts for HRA, and investment or premium receipts for 80C and 80D — even if no Form 16 listed them.
What is the due date for AY 2026-27?
31 July 2026 for individuals filing ITR-1 or ITR-2 without audit. Business and professional returns under ITR-3 / ITR-4 (non-audit) are due 31 August 2026.
